2. What categories of data do we use as an employer and where do they come from?
The categories of personal data processed include, in particular, your master data (such as first name, last name, name affixes), contact data (such as private address, (mobile) telephone number, email address), as well as all data resulting from your application documents (including, if applicable, health data, if included).
Your personal data is generally collected directly from you as part of the application process. In addition, we may have received data from third parties (e.g. employment agencies).
We also process personal data that we have legitimately obtained from publicly accessible sources (e.g. professional networks).
In the event of discrepancies in your application documents regarding previous employment relationships or other legitimate interests, we may also process data that we obtain from previous employers.
3. For what purposes and on what legal basis is data processed?
We process your personal data in compliance with the provisions of the GDPR, the German Federal Data Protection Act (BDSG) and all other relevant laws (e.g. ArbZG, etc.).
The data processing is used exclusively for the decision on the establishment of an employment relationship. The primary legal basis for this is Art. 6 para. 1 sentence 1 b) GDPR in conjunction with § 26 para. 1 sentence 1 BDSG.
In addition, your separate consent in accordance with Art. 6 (1) sentence 1 a), 7 GDPR in conjunction with § 26 (2) BDSG may be used as a data protection authorisation provision.
If your application documents include photographs, we consider this to be an implied consent to process the photo. In accordance with Art. 7 (3) sentence 1 GDPR, you have the right to withdraw this consent at any time.
Insofar as special categories of personal data (in particular health data, e.g. a severe disability) are processed in accordance with Art. 9 (1) GDPR, this serves exclusively to fulfil the obligations incumbent on us under § 164 SGB IX (German Social Security Code) as part of the application process.
Should we wish to process your personal data for a purpose not mentioned above, we will inform you in advance about this and about the legal basis for doing so.
If necessary, we would like to keep your application documents for future job postings should your application for a specific vacancy not be successful. In this case, we will obtain a separate declaration of consent from you.
4. Who receives your data?
Within our company, only those persons and departments (e.g. human resources, specialist department) that are responsible for the specific application process receive your personal data.
5. What data protection rights can you assert as the data subject?
You can request information about the data stored about you at the above address. In addition, under certain conditions, you can request the correction or deletion of your data. You may also have the right to restrict the processing of your data and the right to have the data you have provided released in a structured, common and machine-readable format.
6. Where can you complain?
You have the option of contacting the above-mentioned data protection officer or the Rhineland-Palatinate State Data Protection Officer with a complaint.
7. How long will your data be stored?
We will delete your personal data as soon as it is no longer required for the above-mentioned purposes. In addition, personal data may be stored for the period during which claims can be asserted against us (statutory limitation period of three years).
8. Is your data transferred to a third country?
We do not transfer personal data to third parties outside the European Economic Area (EEA).
9. To what extent do automated individual decision-making or profiling measures take place?
We do not use any purely automated processing to make a decision – including profiling – regarding the establishment of an employment relationship.
10. Further information
We use transport encryption (TLS v1.2) for email communication. Content encryption does not take place.
Regardless of this, your email provider is responsible for the encryption of emails sent by you.
